Online Statements (the "Service") is provided by City National Bank of Florida ("City National Bank of Florida", "we" and "us").

These Terms of Use set forth the terms and conditions for any use of the Service. We encourage you to read these Terms of Use carefully.

By clicking the "ACCEPT” button at the end of these Terms of Use, you signify your agreement to all the terms, conditions, and notices contained or referenced in this document and accept responsibility for your use of the Service. Please read these Terms of Use carefully before you accept them. If you choose to click the "I decline" button you will not be enrolled in the Service and will have no further responsibility to City National Bank of Florida.

Access to the Service and use of the Service is subject to all applicable federal, state and local laws and regulations. Unauthorized use of the Service or information accessed via the Service is strictly prohibited.

1. DESCRIPTION OF ONLINE STATEMENTS
Online Statements are offered for eligible deposit accounts, allowing you to replace your mailed (paper) statement with an electronic version (PDF) that you can view, save to your computer or print at your convenience. Any legal notices that normally accompany your mailed statement will be delivered to you electronically. The following is a brief description of the various features of the Service and requirements for using the Service. From time to time, we may add to, modify, or delete any feature of the Service at our sole discretion. Please note that by enrolling in Online Statements, you will not additionally receive a mailed (paper) statement. However, a monthly paper statement will be available to you upon request by contacting City National Bank of Florida.

A. REGISTRATION FOR ONLINE STATEMENTS. You must first register and become an Online Banking customer to use the Service. You must accept the Terms of Use Agreement to become a registered user of the Service. Your statement(s) will be made available to you when you log into City National Bank of Florida ’s Online Banking and click on the Online Statements link. When you register:

B. ELIGIBLE ACCOUNTS FOR ONLINE STATEMENTS. Eligible accounts include the following personal or non-personal account types: checking, savings, and money market accounts that have recurring periodic statements. All checking, money market and savings accounts that are related under the primary or secondary account holder’s social security number or Tax Identification number will be automatically enrolled for Online Statements. If you have disabled an account that was initially presented on your Online Banking Account Information screen by deselecting it under the User Options, “Change Account Nickname” section of online banking, you will not be able to receive an Online Statement for that account. You must click on the Contact Us link to receive your paper statement for the disabled account.

We hereby reserve the right in its sole and absolute discretion to limit the approval or availability of and the access to the services set forth in this Authorization on any subject account being applied for hereunder to only the individual listed on the bank's records as the primary account holder of such accounts.
  2. If any account, which you have applied for and have been approved by City National Bank of Florida to receive Online Statements, is a joint account, please be advised that only the holder or holders of the account as shown on the Bank's opening documents will receive and be able to access the Online Statement for such account.

C. ENROLLMENT FOR ONLINE STATEMENT DELIVERY. To have access to the Service you must enroll at the City National Bank of Florida site. For accounts with multiple owners, only one account owner need enroll the account in the Service. Your current month’s statement may not be available until your next cycle date.

D. ACCESSING YOUR ONLINE STATEMENTS. Your statement(s) will be made available to you when you log into City National Bank of Florida ’s Online Banking and click on the Online Statements link. Your statement will be provided in a readable, printable, and downloadable format.

E. CHANGE STATEMENT DELIVERY METHOD. When you enroll for Online Statement Delivery, City National Bank of Florida will no longer mail paper statements for any account that is receiving an Online Statement, however, a monthly paper statement will be available to you upon request by contacting City National Bank of Florida . Note: If you have disabled an account that was initially presented on your Online Banking Account Information screen by deselecting it under the User Options, “Change Account Nickname” section of Online Banking, you will not be able to receive an Online Statement for that account. You must click on the Contact Us link to receive your paper statement for the disabled account

Each month you will receive a notification from City National Bank of Florida informing you that your monthly statement is available online. You will receive this notification via e-mail, thus making it imperative that you notify City National Bank of Florida of any e-mail address changes. You can change your e-mail address within City National Bank of Florida Online Banking by clicking on the User Options link. You can also notify City National Bank of Florida of any change in your e-mail address by clicking the Contact Us link or calling the Electronic Banking Department at (866) CNB-EPAY. . A monthly paper statement will be available to you upon request by contacting City National Bank of Florida . If you want to receive your paper statement, you will need to Contact Us to reinstate this feature. Additional fees may apply, refer to appropriate fee schedule.

F. EQUIPMENT. You are responsible for and must provide all telephone and other equipment, software (other than any software provided by us) and services necessary to access the Service.

2. INTERNATIONAL USE
City National Bank of Florida does not make any representation that any content or use of the Service is appropriate or available for use in locations outside of the United States and accessing the Service from territories where its contents or use is illegal and is prohibited by City National Bank of Florida. Those who choose to access the Service from locations outside the United States do so at their own risk and are responsible for compliance with local laws.

3. CHANGE IN TERMS OF USE
City National Bank of Florida reserves the right to modify these Terms of Use at any time. Any modifications shall be effective when they are posted on the Service. You will be notified as soon as possible when any changes are made which materially affect your rights, such as changes regarding how your information is maintained or used. It is your responsibility to review these Terms of Use including the City National Bank of Florida Privacy Policy from time to time in order to be aware of any such changes.

4. TERMINATION
These Terms of Use will be in effect from the date your registration is submitted by you and accepted by City National Bank of Florida and at all times while you are using the Service. Either you or City National Bank of Florida may terminate this Agreement and your use of the Service at any time.

As a customer of City National Bank of Florida you do have the right to have mailed to you a paper statement in place of an electronic one (Online Statement).

5. MISCELLANEOUS
These Terms of Use will be construed and interpreted in accordance with the laws of the State of Florida , without reference to its conflict-of-laws rules. The sole jurisdiction and venue for actions related to the subject matter hereof shall be the Florida state and U.S. federal courts located in Miami , Florida . In any action or proceeding to enforce rights under these Terms of Use, the prevailing party will be entitled to recover costs and attorneys' fees. If any provision of these Terms of Use is held to be invalid or otherwise unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be invalidated or otherwise affected. Headings are for reference only and in no way define, limit, construe, or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These Terms of Use represent the sole and exclusive agreement between you and City National Bank of Florida regarding the Service and merges and supersedes all previous and contemporaneous written or oral agreements and understandings regarding the subject matter hereof. City National Bank of Florida may assign the Service, including these Terms of Use in whole or in part; however, you may not assign or transfer these Terms of Use. Should any term or condition be in conflict between these Terms of Use and any document incorporated herein by reference into these Terms of Use, the Terms of Use shall control.

Customer by accepting Terms of Use verifies that he or she has the equipment and Internet access as referenced in paragraph 1F.
